Prospective Marriage Visa (Subclass 300)

The Subclass 300 Visa is available to those who intend to marry an Australian Citizen, an Australian Permanent Resident or an eligible New Zealand Citizen. The visa allows you to enter Australia and marry your intended partner within the visa’s nine (9) month validity period.  

When granted, you must enter before you marry your partner, may leave and re-enter Australia as many times as you wish before your visa expiry date. You can live with your partner, work and study (with no access to government funding) in Australia whilst on this visa.

Once you marry your spouse, you can continue to settle and live with your Spouse by applying for a Subclass 820 and 801 visa application.   

Length of Stay

  • 9 months


Partner/ Spouse Visa (Subclass 820/ 801 & 309/100)

The Subclass 820/ 801 (Onshore) and 309/ 100 (Offshore) Visa allows the partner or spouse of an Australian Citizen, an Australian Permanent Resident or an eligible New Zealand Citizen to live and settle in Australia.  

The visa is a two-stage process allowing you to be approved for a temporary visa (Subclass 820 or 309) and being eligible for the permanent visa (Subclass 801 or 100) after 2 years (unless you and your partner have been in a long-term relationship).  

To be eligible for this visa, you must:

  • be of legal age (18 years and over)

  • have an approved sponsor

  • be married or in a de-facto relationship

  • demonstrate that you are in a genuine and continuing relationship.

  • meet character and health requirements

The visa allows you to live and work in Australia. It enables you to stay in Australia indefinitely, enrol in Australia’s public health care scheme (Medicare), sponsor eligible relatives to come to Australia and apply for Australian citizenship (when eligible).

Length of Stay:

  • Indefinitely


PARENT VISAS

The Parent Visas allow parents to migrate and join their children in Australia on a temporary or permanent basis. It requires sponsorship from an eligible child who is a settled Australian Citizen. Australian Permanent Resident or an eligible New Zealand Citizen.

 There are several types of Parent visas:

  • Parent Visa (Subclass 103)

  • Aged Parent Visa (Subclass 804)

  • Contributory Parent Visa (Subclass 173)

  • Contributory Parent Visa (Subclass 143)

  • Contributory Aged Parent Visa (Subclass 884)

  • Contributory Aged Parent Visa (Subclass 864)

  • Sponsored Parent Visa (Subclass 870)

Determining which type is the most suitable would generally depend on your parent(s)’s age, location, duration of stay and the sponsor’s financial situation.


CHILD VISA

A sponsor who is an Australian Citizen, Australian Permanent Resident or eligible New Zealand citizen, can apply to have their natural child, adopted child or step child join them in Australia.

When a child is born and at least one of their parents are an eligible sponsor at the time of birth, the child automatically acquires Australian citizenship.

When a child however is born and one of their parents later becomes an Australian Citizen or Australian Permanent Resident, they will need to apply for and granted a visa to be able to enter and join their parents in Australia.

There are several types of Child visas:

  • Child Visa ( 802 - Onshore & Subclass 101 - Offshore)

  • Adoption Visa (Subclass 102)

  • Orphan Relative Visa (837 - Onshore & Subclass 117 - Offshore)

  • Dependent Child Visa (Subclass 445)

Length of Stay:

  • Indefinitely


REMAINING RELATIVE VISA (SUBCLASS 115 & 835)

The Remaining Relative Visa has been designed for those whose only near relatives are living in Australia, and they are the only one left in their home country.

This visa allows them to join their family by being sponsored by their Australian Citizen, Australian Permanent Resident or eligible New Zealand citizen relative.

To be eligible, you either need to be a parent, grandparent (including biological and step-parent), a sibling, step sibling or child (including stepchild) of an eligible sponsor. You also need to be at least 18 years of age and are not in your or your partner’s daily care and control.

Length of Stay:

  • Indefinitely
